This Product Safety Disclaimer, Assumption of Risk & Limitation of Liability (“Safety Disclaimer”) applies to products purchased from or distributed through FullyTackled.com, operated by We Are Fully Tackled Tackle Company, doing business as Fully Tackled (“Fully Tackled,” “we,” “us,” or “our”).

Fishing tackle, fishing tools, hooks, weights, line, lures, small components, and fishing activities involve inherent risks.

PLEASE READ THIS SAFETY DISCLAIMER CAREFULLY BEFORE PURCHASING, OPENING, HANDLING, GIFTING, POSSESSING, OR USING ANY FULLY TACKLED PRODUCT.

By purchasing a product from Fully Tackled, you acknowledge that you have been provided an opportunity to review this Safety Disclaimer and agree to its terms to the maximum extent permitted by applicable law.

By opening, accepting, possessing, handling, or using fishing tackle sold by Fully Tackled, the user acknowledges the inherent risks associated with fishing equipment and accepts responsibility for safe, lawful, and appropriate use to the maximum extent permitted by law.

1. Fishing Tackle Is Inherently Capable of Causing Injury

Fishing tackle is designed to perform functions that inherently involve sharp, pointed, weighted, penetrating, cutting, hooking, or tensioned components.

A fishing hook capable of penetrating a fish can also penetrate human skin.

A sinker or lure heavy enough to be cast may injure a person if it strikes them.

Fishing line strong enough to land a fish may cut, entangle, or constrict.

Fishing tools may contain sharp edges, cutting surfaces, pinch points, or pointed ends.

The fact that a product is functioning exactly as intended does not mean the product is incapable of causing injury.

2. Fishing Hooks Are Sharp

Fishing hooks are intentionally sharp and may cause serious puncture wounds, lacerations, eye injuries, or other injuries.

Products may contain:

Treble hooks
Barbed hooks
Jig hooks
Multiple exposed hooks
Concealed or partially concealed hooks

Exercise extreme care while:

4. Children and Adult Supervision

Fishing can be enjoyed by families and children; however, fishing tackle is not a toy.

5. Pets and Animals

Hooks, fishing line, soft plastics, lures, weights, packaging, and other tackle may cause serious injury or death if swallowed or entangled by pets or other animals.

Do not allow pets to play with, chew, lick, or swallow fishing tackle.

If a person or animal swallows a hook, lure, line, weight, soft plastic, or other potentially hazardous item, seek appropriate medical or veterinary assistance.

6. Lead and Other Materials

Certain fishing weights, sinkers, jig heads, or other tackle may contain lead or other metals or materials requiring appropriate handling.

When handling lead-containing fishing tackle:

Wash hands after handling.
Avoid eating or drinking while handling it.
Do not place it in your mouth.
Keep it away from children.
Keep it away from food-preparation surfaces.
Do not intentionally melt, grind, sand, burn, or otherwise process it.

8. Fishing Line

Fishing line can cut skin and may create entanglement, constriction, and strangulation hazards.

Do not wrap fishing line tightly around:

when attempting to pull or break snagged line.

Use appropriate tools and safe techniques.

Discard fishing line responsibly.

Loose fishing line can injure people, pets, birds, fish, and wildlife.

9. Casting Safety

Fishing lures, hooks, sinkers, and other tackle may travel at high speed while casting.

Before every cast:

Look behind you.
Look beside you.
Check for people and animals.
Check for overhead obstacles.
Maintain adequate distance from other anglers.
Inspect the lure and attachment.
Inspect the line and knot.
Be aware of nearby electrical lines.

Never intentionally cast toward another person or animal.

10. Snagged Tackle

Snagged tackle may suddenly release and travel toward an angler at high speed.

Never pull snagged tackle directly toward your:

Head
Eyes
Body
Another person

Exercise extreme care when retrieving snagged hooks or lures.

Appropriate eye protection should be considered when circumstances warrant it.

11. Inspect Products Before Use

Users are responsible for inspecting fishing tackle before use.

Do not use equipment that appears:

Broken
Cracked
Severely corroded
Structurally damaged
Improperly assembled
Missing critical hardware
Loose
Unsafe
Unreasonably worn

Hooks can dull.

Fishing line can weaken.

Split rings and snaps can deform.

Metal components can corrode.

Lures and tools may become damaged through normal use.

Replace unsafe or damaged equipment when appropriate.

12. Water Exposure and Corrosion

Fully Tackled primarily focuses on freshwater fishing products.

Water exposure can cause corrosion and deterioration.

After fishing, users should:

Allow wet tackle to dry.
Inspect hooks.
Inspect metal hardware.
Clean equipment when appropriate.
Store products in a reasonably dry environment.

Use in saltwater or harsh environments may accelerate corrosion unless the product is specifically intended for those conditions.

13. Soft Plastics

Soft-plastic fishing lures are intended for fishing use only.

Chew them
Place them in your mouth
Burn them
Intentionally heat them
Use them as toys

Some soft-plastic materials may react with other plastics or lure finishes during storage.

Ice conditions can vary dramatically within the same lake, river, pond, or body of water and can change rapidly.

Lacerations
Eye injuries
Permanent injury
Infection
Pinching or crushing injuries
Choking
Ingestion
Lead or material exposure
Entanglement
Strangulation
Falls
Drowning
Property damage
Injury to other people
Injury to pets
Injury to wildlife
Damage caused by casting
Damage caused by snagged tackle
Damage caused by improperly stored tackle

BY PURCHASING, OPENING, ACCEPTING, POSSESSING, HANDLING, GIFTING, OR USING A PRODUCT SOLD BY FULLY TACKLED, YOU ACKNOWLEDGE THE INHERENT AND FORESEEABLE RISKS ASSOCIATED WITH FISHING TACKLE AND VOLUNTARILY ASSUME THOSE RISKS TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

The user accepts responsibility for determining whether the product and fishing activity are appropriate under the circumstances.

27. Purchaser and User Responsibility

The purchaser and user are responsible for exercising reasonable care in the:

Possession
Storage
Transportation
Handling
Maintenance
Inspection
Modification
Casting

28. Release of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BY PURCHASING OR USING FULLY TACKLED PRODUCTS, THE PURCHASER AND USER AGREE TO RELEASE, WAIVE, AND HOLD HARMLESS WE ARE FULLY TACKLED TACKLE COMPANY, D/B/A FULLY TACKLED, AND ITS OWNERS, MEMBERS, EMPLOYEES, AGENTS, CONTRACTORS, REPRESENTATIVES, AND AFFILIATES FROM CLAIMS FOR INJURY, DEATH, PROPERTY DAMAGE, LOSS, COSTS, OR OTHER DAMAGES ARISING FROM OR RELATING TO THE ORDINARY AND INHERENT RISKS ASSOCIATED WITH FISHING OR THE POSSESSION, STORAGE, TRANSPORTATION, HANDLING, SELECTION, MODIFICATION, OR USE OF FISHING PRODUCTS.

TO THE EXTENT LEGALLY WAIVABLE, THIS RELEASE IS INTENDED TO INCLUDE CLAIMS ALLEGING ORDINARY NEGLIGENCE BY FULLY TACKLED OR ITS REPRESENTATIVES IN CONNECTION WITH SUCH RISKS.

This release applies only to the extent permitted by applicable law.

29. Specific Conduct Covered by Release

To the maximum extent permitted by law, Fully Tackled shall not be responsible for injuries or damages arising from or related to:

Improper use
Misuse
Careless use
Reckless use
Failure to inspect a product
Failure to maintain equipment
Failure to follow warnings
Failure to follow instructions
Failure to supervise children
Unsafe storage
Unsafe casting
Unsafe retrieval
Snagged tackle
Product modification
Improper hook handling
Improper tool handling
Improper line handling
Improper lead handling
Use around children or pets
Failure to use protective equipment
Failure to follow fishing laws
Use in unsafe environmental conditions
Use for an unintended purpose

30. Ordinary Negligence

Where applicable law permits the release or limitation of claims based upon ordinary negligence, the purchaser and user expressly acknowledge and agree that this Safety Disclaimer is intended to release and limit such claims to the fullest legally enforceable extent.

This provision does not waive liability that applicable law prohibits a party from releasing or limiting.

31. Purchases for Other People and Gifts

If you purchase or transfer Fully Tackled products for another person, you are responsible for passing along:

32. Resale or Redistribution

A purchaser who resells, redistributes, repackages, modifies, or transfers a product is responsible for maintaining and passing along applicable warnings and instructions.

Fully Tackled is not responsible, to the maximum extent permitted by law, for changes made by unauthorized resellers or other third parties after a product leaves Fully Tackled's control.

33. Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS WE ARE FULLY TACKLED TACKLE COMPANY, D/B/A FULLY TACKLED, AND ITS OWNERS, MEMBERS, EMPLOYEES, AGENTS, CONTRACTORS, AFFILIATES, AND REPRESENTATIVES FROM CLAIMS, DEMANDS, ACTIONS, DAMAGES, LOSSES, LIABILITIES, JUDGMENTS, COSTS, AND REASONABLE EXPENSES ARISING FROM OR RELATING TO YOUR:

Misuse of a product
Unsafe handling of a product
Reckless or negligent handling
Modification of a product
Failure to follow warnings
Failure to follow instructions
Failure to supervise a child
Improper transfer of products to another person
Violation of fishing laws
Violation of other applicable laws
Use of a product for an unintended purpose
Injury caused to another person by your conduct
Damage caused to another person's property by your conduct
Unauthorized resale or repackaging
Violation of this Safety Disclaimer

This obligation applies only to the extent legally enforceable and does not require a purchaser or user to indemnify Fully Tackled for liability that applicable law prohibits us from shifting to another party.

34. Customer Modification and Alteration

To the maximum extent permitted by law, Fully Tackled assumes no responsibility for damage or injury resulting from alterations made after the product leaves our control.

Adding hooks
Changing split rings
Removing components
Adding weights
Altering weights
Repainting
Cutting
Grinding
Drilling
Heating
Melting
Bending
Welding
Altering tools
Combining products in an unsafe manner

Michigan law provides defenses concerning product alteration in certain circumstances, including where the alteration caused the harm and was not reasonably foreseeable.

35. No Warranty of Absolute Safety

Fully Tackled does not warrant or represent that fishing equipment is incapable of causing injury.

No warning can eliminate all risks inherent in:

Sharp hooks
Weighted tackle
Cutting tools
Fishing line
Water
Outdoor activities
Fishing itself

Users are required to exercise reasonable judgment and care.

36. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ARE FULLY TACKLED TACKLE COMPANY, D/B/A FULLY TACKLED, AND ITS OWNERS, MEMBERS, EMPLOYEES, AGENTS, CONTRACTORS, AFFILIATES, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE PURCHASE, POSSESSION, STORAGE, HANDLING, TRANSPORTATION, MODIFICATION, OR USE OF A PRODUCT.

Where liability cannot legally be excluded but may lawfully be limited, Fully Tackled's aggregate liability arising from a particular purchased product shall not exceed the amount actually paid to Fully Tackled for that product, except where applicable law requires otherwise.

37. Third-Party Products

Some products sold or included in Fully Tackled assortments may be manufactured by third parties.

Fully Tackled does not assume responsibility for unauthorized modifications, undisclosed changes, or misuse occurring after such products leave our control.

Any manufacturer warranty, where available, may be subject to separate terms issued by that manufacturer.

Nothing in this section eliminates any responsibility that applicable law places upon Fully Tackled as a seller.

38. Failure to Follow Safety Standards

Fully Tackled is not responsible, to the maximum extent permitted by law, for harm resulting from a purchaser's or user's failure to follow:

Published warnings
Product instructions
Manufacturer instructions
Commonly accepted fishing safety practices
Applicable government safety requirements
Applicable fishing regulations
Reasonable standards of care

Where a person consciously chooses to disregard known risks or warnings, that person accepts responsibility for the consequences of doing so to the fullest extent permitted by law.

39. No Medical Advice

Fully Tackled does not provide medical advice.

If an injury occurs, obtain appropriate medical assistance.

Seek immediate professional medical attention for serious injuries including:

Deeply embedded hooks
Eye injuries
Significant bleeding
Swallowed hooks
Suspected poisoning
Severe allergic reaction
Serious puncture wounds
Other emergencies

Contact emergency services where appropriate.

Do not rely upon customer service personnel for medical diagnosis or treatment.

40. Emergency Situations

If a fishing hook enters an eye, throat, major blood vessel, or other sensitive area, or if fishing tackle is swallowed or causes a serious injury, seek emergency medical treatment.

Do not attempt dangerous self-removal procedures.

41. Environmental Responsibility

Users should:

Retrieve discarded line when safe to do so.
Dispose of hooks responsibly.
Dispose of lead-containing tackle appropriately.
Avoid leaving plastics or packaging near waterways.
Follow applicable environmental rules.

Fully Tackled is not responsible for environmental harm resulting from improper disposal or use of products by customers.

42. Relationship to Other Fully Tackled Policies

Nothing in this policy is intended to excuse Fully Tackled from a duty that applicable law specifically requires it to perform.

Michigan's product-liability statutes expressly preserve seller liability in certain circumstances, including a seller's failure to exercise reasonable care, and Michigan's warning statute expressly states that it does not eliminate a seller's continuing duty to exercise reasonable care where applicable.

Accordingly, all releases, waivers, indemnification provisions, and limitations contained in this Safety Disclaimer apply only to the maximum extent permitted by applicable law.

44. Severability

If any provision of this Safety Disclaimer is found invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent legally permissible, and the remaining provisions shall remain in effect to the extent permitted by law.

45. Agreement by Purchase

BY COMPLETING A PURCHASE THROUGH FULLYTACKLED.COM, YOU ACKNOWLEDGE THAT YOU HAVE HAD THE OPPORTUNITY TO REVIEW THIS PRODUCT SAFETY DISCLAIMER AND AGREE TO ITS TERMS TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You acknowledge that fishing tackle inherently presents risks and that you accept responsibility for safely storing, handling, transporting, and using the products you purchase.

46. Agreement by Use

BY OPENING, ACCEPTING, POSSESSING, HANDLING, OR USING A PRODUCT SOLD BY FULLY TACKLED, THE USER ACKNOWLEDGES THE INHERENT RISKS ASSOCIATED WITH FISHING TACKLE AND ACCEPTS RESPONSIBILITY FOR SAFE AND LAWFUL USE TO THE MAXIMUM EXTENT PERMITTED BY LAW.

If you do not understand how to safely use a product, do not use it until you obtain appropriate instruction or assistance.

47. Governing Law

This Safety Disclaimer is governed by the laws of the State of Michigan, except where another jurisdiction's applicable law must control.

To the extent legally permissible, disputes arising under this Safety Disclaimer shall be handled in an appropriate court serving Marquette County, Michigan.
